GLUED PTY LTD

We are Glued Pty Ltd ABN 34 572 351 853 of Shop3/158 Bay Street, Port Melbourne, Victoria 3207, Australia and are referred to below as ‘Glued Pty Ltd’, ‘Glued’,’us’ or ‘our’. You, the Glued member, renter or any authorised renter are referred to as the ‘customer’, ‘member’ or ‘you’.

These Terms and Conditions form the basis of your membership to Glued Pty Ltd and they govern your use of Glued products and services. By becoming a Glued member or by renting any rental items using a credit card you accept and agree to be bound by these Term and Conditions. These terms and conditions are an ongoing contract between you and Glued Pty Ltd and apply to your use of the Glued service.

GENERAL CONDITIONS OF USE

You agree to abide by the Glued Pty Ltd Terms and Conditions as set out below.
To rent any rental item you must use a valid credit card or membership card. Glued Pty Ltd reserves the right to refuse to rent any rental item to you at any time.
You will accept full liability for any and all charges and amounts due to Glued Pty Ltd.
You hereby authorise Glued Pty Ltd to debit your current credit card account in order to recover all charges and amounts due and owing to Glued Pty Ltd, including but not limited to, extra rental fees, rental item replacement costs, malicious damage, and reasonable legal costs incurred in connection with the recovery of all outstanding charges and amounts owing by you.
If you fail to return any rental items(s) when due you will be charged an extra day rental fees for each day overdue up to a maximum of 21 days.
You agree to return any rental items(s) in the same condition as when hired out. All rental items shall be deemed to have been received by you in good condition. If any damage (malicious or otherwise) is caused to any rental item while rented to you, Glued Pty Ltd will debit from your membership card or Credit Card account an amount equal to the Recommended Retail Price of the rental item(s).
You agree that all rental items will be returned to the machine in the original case in which it was dispensed.
For the purposes of these Terms and Conditions the Recommended Retail Price shall mean the retail price recommended for the sale of the rental item(s) as specified by the manufacturer and/or distributor, or in the absence of such recommendation Glued Pty Ltd normal price of the rental item(s) applicable at the date the charge is debited.
If you do not have a Credit Card or your Credit Card has expired or you have exceeded your Credit limit, Glued Pty Ltd will instruct a credit agency to recover all charges and amounts due and owing to Glued Pty Ltd, including but not limited to the charges and amounts set out in Clause 5 and you consent to the provision of personal details held by Glued Pty Ltd relating to you to be passed to such credit agency.
You must notify Glued Pty Ltd if you change your phone number or email address. All correspondence will be deemed to have been served upon you, if directed to the details last notified to Glued Pty Ltd.
If the machine is out of service it is the customer’s responsibility to arrange for the movie to be returned at a time no later than 48 hours otherwise extra rental fees will apply.
You authorise Glued Pty Ltd to charge your Credit Card upon rental of a rental item and your credit card will be charged with the daily rental fee until it is returned. No charge will be made until your DVD has been returned to the machine, upon which a charge will be made to the authorised account for the due amount set in Glued Pty Ltd tariffs as outlined on the Glued machine.
As a Glued member you are able to rent two titles at a time and as a credit card user you are only able to rent one title at a time.
Only the Glued card holder can use the card to rent dvds, blu-rays and/or games. The Glued membership card is a non-transferrable card.
You as a Glued member will not allow any minors access to dvds and games that are prohibited from viewing by minors. All memberships can be tailored with two pin numbers allowing different levels of access. This is established at time of joining and can be changed at any time by coming in to a Glued store.

DISCLAIMERS OF WARRANTIES AND LIMITATIONS ON LIABILITY

The Glued Pty Ltd service is provided ‘as is’ and we make no representations or warranties of any kind with respect to the Glued Pty Ltd contents or our service. We assume no liability or responsibility for any errors or omissions in the content of the Glued Pty Ltd content, any failures, delays, or interruptions in the service. We disclaim all representation and warranties, including, for example warranties of merchantability, fitness for a particular purpose, and non-infringement. In addition, we do not represent or warrant that the information accessible via our machine is accurate, complete or current.
In no event shall Glued Pty Ltd, its shareholders, directors, officers, or employees be liable (jointly or severally) to you for any special, incidental, indirect or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data or profits, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Glued Pty Ltd service. If any applicable authority holds any portion of this section to be unenforceable, then liability will be limited to the fullest possible extent permitted by applicable law.

COPYRIGHT

All content included on the Glued Pty Ltd service and delivered to subscribers as part of the service, including DVDs, Blu-Ray discs and videogames, is the property of Glued Pty Ltd and is protected by the Australian and international copyright laws. Glued Pty Ltd reserves the right to terminate all accessibility hereunder if Glued Pty Ltd, in its sole and absolute discretion, believes that you are in violation of this paragraph, such violations including the copying of DVDs and games rented to you by us or the copying or other unauthorised use of our proprietary content. Glued Pty Ltd does not promote, foster or condone the copying of DVDs or any other infringing activity. The use of DVDs rented to you by us is solely for your personal and non-commercial use.

ELECTRONIC COMMUNICATIONS

By using the Glued Pty Ltd service, you consent to receiving electronic communications or text messages from Glued Pty Ltd. These communications will include notices about your account and information concerning or related to our service, such as featured films or other entertainment information or offerings. These communications are part of your relationship with Glued Pty Ltd and you receive them as part of your Glued Pty Ltd subscription. You agree that any notice, agreements, disclosure or other communications that we send to you electronically will satisfy any legal communication requirements, including that such communications be in writing.

LIMITATIONS ON USE

You must be 18 years of age or older to be a member of Glued Pty Ltd and only the card holder can use the card to rent movies, blu-rays and games. While individuals under the age of 18 may utilize the service, they may do so only with the involvement of a parent or legal guardian. While Glued Pty Ltd does distribute products that may be watched by children, we do not intentionally seek to collect information from underage individuals. Underage individuals may have a membership card with a pin number giving them access only to those areas approved and chosen by their parent/guardian. Unless otherwise specified, the content on the Glued machine is for your personal and non-commercial use and we grant you a limited license to access for that purpose. Glued Pty Ltd does not promote, foster or condone the copying of DVDs or any other infringing activity.

SALE OF PREVIOUSLY VIEWED TITLES AND GAMES

We offer select previously-viewed titles for sale on our machine. The titles available for sale may change from time to time and are subject to continued availability. Your purchase will be charged to your chosen credit card or membership card. All movies, Blu-Ray discs and games are sold ‘as is’. There are no refunds on titles purchased on the machine.

RIGHT TO TERMINATE

We reserve the right to terminate or restrict your use of our service, without notice, for any or no reason whatsoever.

CHANGES TO TERMS AND CONDITIONS

Glued Pty Ltd reserves the right, from time to time, with or without notice to you, to change these Terms and Conditions at our sole and absolute discretion. The most current version of these Terms and Conditions can be viewed on our website www.glued.com.au. The most current version of our Terms and Conditions will supersede all previous versions. Your continued use of the Glued Pty Ltd service after changes are made means that you agree to be bound by such changes.
